RangeWater Privacy Policy

RangeWater Real Estate, LLC and its affiliated companies (collectively, “RangeWater,” “us,” “we,” or “our”) respect your privacy and we are committed to protecting it through our compliance with this privacy policy (“Privacy Policy”). This Privacy Policy lets you know the types of information that we may collect from you, or that you may provide, when you interact with RangeWater or its managed properties, and our practices for collecting, using, maintaining, protecting, and disclosing that information. It applies to information that we process through the following channels (“Communication Channels”):

  • our website at www.liverangewater.com (the “Site”) or any website of ours that links to this Privacy Policy, including managed property websites;
  • mobile or embedded website applications, or any other application of ours that links to this Privacy Policy;
  • when you apply to lease or are leasing at a RangeWater managed property;
  • RangeWater-hosted events, property visits, or other offline interactions; and
  • general inquiries such as tenant surveys, exchanges by telephone, text message, electronic mail, or postal mail, and in person requests. 

By interacting with us or using the Communication Channels in any manner, you acknowledge and accept the practices and policies described in this Privacy Policy, and you hereby consent that we may collect, use, and share your information as described herein. If you do not agree with the practices and policies described herein, it is your choice not to share your information with us. 

We also provide commercial property management and other services to other businesses, enterprises, and investors (our “customers”). This Privacy Policy does not apply to personal information that we process on behalf of our customers (“Customer Data”). We process Customer Data in accordance with the terms of our customer agreements in our capacity as a service provider. 

This Privacy Policy also does not apply to information collected by any third party, including through any third-party application or third-party consent that may link to or be accessible from or on our Site, or to activities governed by a separate privacy policy that does not incorporate this Privacy Policy. 

Depending on where you are located, there may be differences in the types of information collected, used, and disclosed, or you may have different rights. For additional details specific to your region, please see the Location-Specific Disclosures section of this Privacy Policy.

  1. TYPES OF INFORMATION WE PROCESS

To provide our products and services, we process information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you as an individual (“Personal Information”). We may process the following types of Personal Information: 

  • Contact Information such as your name, postal address, email address, phone number, date of birth, picture, emergency contacts, or other similar information.
  • Other Personal Identifiers such as your username, account name, Social Security number, taxpayer identification number, driver's license number, passport number, identity card, resident identification number, your signature, or other similar identifiers. 
  • Demographics Information such as your age, gender, sex, marital status, citizenship, criminal history, and source of income, subject to applicable state or federal laws. 
  • Commercial Information such as records of products or services purchased, obtained, or considered, other purchasing histories or tendencies, utility bills, lease information, rental history, rent amount, rental applicant screening information, and information related to your rental such as pet and vehicle information (year, make, model).
  • Financial and Insurance Information such as your bank account, credit card and debit card number, your credit history, rent payment information, source of income, insurance policy information, and other financial or tax documentation.
  • Internet and Device Information such as browsing history, search history, internet protocol address, cookie identification, information regarding your interaction with a website, internet postings, location data, device model, software version and other device characteristics, mobile app identifiers, activity and engagement data.
  • Sensory Data such as pictures, videos, recorded calls, and other audio and/or visual media. 
  • Employment or Professional Information such as education, employment history, job title, school attendance, other CV information, pay history, and income.
  • Inferences about your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes, drawn from any of the above categories of information, including to create a profile about you. 

The categories of Personal Information that we process depend on your interactions and engagement with us, and include information you choose to provide us, information provided to us on your behalf, information we obtain automatically when you interact with us, and information from other sources such as third-party services.

  1. COOKIES AND TRACKING TECHNOLOGIES

We process certain data collected automatically from cookies, web beacons, and other technologies. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server.

We may use these automated technologies to collect information about your equipment, browsing actions, and usage patterns. The information we obtain in this manner may include your device IP address, identifiers associated with your devices, Internet service provider, types of devices connected to our services, web browser characteristics, device characteristics, language preferences, referring/exit pages, clickstream data, dates and times of visits to the Communication Channels, number of links you click while using the Communication Channels, search terms, operating system, website traffic and related statistics, keywords and other data about your device and use of the Communication Channels.

  • Essential Cookies: These cookies are necessary for the basic functioning of certain of our Communication Channels. They enable you to navigate our Communication Channels and use essential features.
  • Performance/Analytics Cookies: These cookies allow us to analyze how you use certain of our Communication Channels so we can measure and improve their performance.
  • Functionality Cookies: These cookies allow certain of our Communication Channels to remember your preferences and provide enhanced functionality.
  • Targeting/Advertising Cookies: These cookies are used to deliver advertisements that are more relevant to you and your interests. They are also used to limit the number of times you see an advertisement and to help measure the effectiveness of advertising campaigns. We partner with third-party advertising networks that use cookies for these purposes.

Third-Party Analytics Services

We use third-party web analytics services in connection with the Communication Channels, including Google Analytics. These service providers use automated technologies to collect data (such as IP addresses and browsing behavior) to evaluate the use of the Communication Channels. These third-party analytics providers may set cookies on your device. Online Tracking and Targeted Advertising

Through our Communication Channels, we may collect information about your online activities to provide you with advertising about products and services tailored to your interests.Where required by applicable law, we will obtain your consent for the processing of your personal information for direct marketing purposes.

You may see certain ads on other websites because we participate in advertising networks. Ad networks allow us to target our messaging to users through demographic, interest-based and contextual means. These networks track your online activities over time by collecting information through automated means, including through the use of cookies, web server logs, and web beacons. The networks use this information to show you advertisements that may be tailored to your individual interests. The information our ad networks may collect includes information about your visits to websites that participate in the relevant advertising networks, such as the pages or advertisements you view and the actions you take on the websites. This data collection takes place both on our websites and on third-party websites that participate in the ad networks. This process also helps us track the effectiveness of our marketing efforts. 

Some of the activities described in this section may constitute “targeted advertising,” “sharing,” or “selling” under certain laws. Depending on the laws of the state in which you reside, you may have the right to opt out of targeted advertising, sharing, and sales of your Personal Information. Choices to Control Automated Data Collection and Tracking

Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without cookies you may not be able to use all of the features of the Communication Channels. 

Your browser settings also may allow you to transmit a “Do Not Track” signal when you visit various websites. Our Communication Channels are not configured to respond to “Do Not Track” signals received from browsers. However, our Communication Channels may recognize certain opt-out preference signals, such as the Global Privacy Control, in which case, we will process these signals as requests to opt out of targeted advertising and requests to not “sell” or “share” your personal information according to applicable law. You may set such a signal through your browser or browser extension. 

For mobile devices, you can manage how your device and browser share certain device data by adjusting the privacy and security settings on your mobile device.

We use Personal Information for the following purposes related to our business, or as otherwise described at the time of collection or upon consent if required by law:

  • To provide and manage residential leasing and property management products and services such as establishing and managing resident accounts, processing lease applications, applying for and obtaining credit, drafting and administering lease agreements, managing property operations, and fulfilling related obligations. 
  • To enable business communications related to tenancy and property management such as facilitating communications about leases, rent payments, renewals, property-related reminders and notices, responding to inquiries and other contractual matters. 
  • To process payments and manage accounts such as invoicing, processing rent and other payments, managing financial transactions, generating statements, and administering resident accounts. 
  • To provide customer and technical support and respond to inquiries such as addressing resident requests, resolving issues, and providing assistance related to our services and the Communication Channels. 
  • To operate, administer, evaluate, develop, manage, and improve our business, products, and services such as analyzing business operations, developing new services, conducting market research and data analytics, quality assurance, and improving communication effectiveness. 
  • To communicate with you regarding news, updates, notices, advertisements, and marketing materials such as providing information about our properties, services, promotions, events, and other offerings that may be of interest, conducting surveys, and gathering feedback.
  • For auditing and compliance management, institutional risk management, and technological development of our systems such as ensuring compliance with legal and regulatory requirements, conducting internal audits, implementing data security measures, and evaluating software.
  • To detect security incidents and protect against malicious, deceptive, fraudulent, or illegal activity such as monitoring and preventing unauthorized access, fraud, and other security threats.
  • To protect against, identify, and prevent fraud, criminal activity, claims, and other liabilities such as conducting background checks, verifying applicant information, and attending to potential or actual legal claims. 
  • To comply with and enforce applicable legal requirements, relevant industry standards, and policies such as ensuring compliance with privacy laws, fair housing laws, and other applicable regulations.
  • In connection with a proposed sale or merger to facilitate business transactions.
  • To manage career opportunities, including for recruitment purposes, employee onboarding, and other human resources purposes such as the recruiting and hiring employees, managing employee information, and administering human resources functions.

We do not sell or otherwise share personal information about you except as described in this Privacy Policy. We may disclose your Personal Information as disclosed to you at the time we collect it, with your consent, and to third parties in the following types of circumstances:

  • Service Providers: We process Personal Information through service providers that perform services on our behalf, which may include services such as technology support and infrastructure; data analytics and reporting; utility management and billing; application processing, resident screening and background checks; rental support services; debt collection; customer service and support; payment processing; order fulfillment; lead generation, scheduling; and related websites and mobile applications. Some of these service providers may use your Personal Information for their own purposes and legal obligations, and where this is the case, these service providers are considered separate data controllers. 
  • Integrated Platform Providers: We utilize third-party platforms to provide website functionality, prospective resident and resident services, and other business functions which collect, access, and process Personal Information. Examples of such providers include Entrata (Entrata’s Privacy Policy), Yardi (Yardi’s Privacy Policy), and RealPage (RealPage’s Privacy Policy), whose products and services are governed by their respective Privacy Policies. 
  • Artificial Intelligence (AI) Tools: We utilize third-party artificial intelligence tools to support our business, including chatbots, website plugins, automatic emails and scheduling, payment management, and lead generation. The data collected through these tools is provided to us by third-party owners and application developers and subject to the privacy policies of the owners of these tools. We use the data captured in accordance with this Privacy Policy and require third-party owners and developers to comply with privacy laws under the terms of their respective contractual agreements for services. 
  • Property Owners, Property Managers, and Other Subsidiaries or Trusted Affiliates: We may process Personal Information from and through other third parties with whom we have a business relationship to provide our products or services, including the owner of any property where you may apply or lease, such as from inquiries, rental applications, site visits, hosted events, and other day to day tenant interactions.
  • Legal and Compliance: We may share Personal Information (1) if we are required to do so by law or legal process (such as a court order or subpoena); (2) in response to requests by government agencies, such as law enforcement authorities; (3) to establish, exercise or defend our legal rights; (4) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (5) in connection with an investigation of suspected or actual illegal activity; or (6) otherwise with your consent.
  • Consumer Reporting Agencies and Other Sources: We may share Personal Information with or process Personal Information from consumer reporting agencies or other public databases. 
  • Business Transactions: If we undergo a business transaction such as a merger, acquisition, sale of assets, joint venture, divestiture, dissolution, liquidation, or reorganization, Personal Information may be transferred or disclosed as part of that transaction.
  1. OTHER ONLINE SERVICES AND THIRD-PARTY FEATURES

The Communication Channels may contain links to third-party websites, products, and services for your convenience and information, including social media sites such as Facebook, Twitter, Instagram, Pinterest, YouTube, and LinkedIn, etc. These third-party websites, products and services may operate independently from us. Personal Information collected by these third-party websites is governed by their privacy practices and is not subject to this Privacy Policy. We may also receive information about you from third parties. For example, if you are on another website and you opt-in to receive information from us, that website will forward us your email address and other information about you so that we may contact you as requested and in accordance with applicable law.

We are not responsible for how these third-party services collect, use, disclose, distribute, or maintain your personal information. We encourage you to learn about the privacy practices of those third parties prior to providing them with any information or taking advantage of an offer or promotion.

  1. CHILDREN’S ONLINE PRIVACY

The Communication Channels are not directed at or intended to be used by children. We do not intentionally collect or solicit personal information from children under the age of 13 (or other relevant age as determined by the applicable law), except for information provided by the relevant parent(s) or guardian(s). If we discover that we have collected any other Personal Information about anyone under such, we will take reasonable steps to promptly delete such information from our systems.

  1. YOUR PRIVACY CHOICES AND RIGHTS

We offer you certain options and choices to express your preferences regarding your Personal Information.

  • Email Consent and Unsubscribe: Our marketing-related and mailing list communications contain a link with instructions on how to unsubscribe. You may need to opt out of communications from individual property sites and mailing lists, and any third-party sites or applications with which you have registered. Opting out of marketing messages will not prevent you from receiving transactional, service-related, or other non-marketing messages as allowed by law. 
  • Cookies and Tracking Data: For information on your choices, please see the Cookies and Tracking Technologies section of this Privacy Policy.
  • Access and Restrictions: We also offer you choices that affect how we handle the Personal Information that we control. Depending on your location and the nature of your interactions with our services, you may be entitled to request access, withdraw your consent, change, delete, restrict the use of, or object to the processing of your Personal Information that was previously provided to us. For your protection, we will verify your identity before fulfilling certain requests. When permitted by law, we may charge an appropriate fee to cover the costs of responding to your request.

  1. DATA SECURITY

We have implemented and maintain appropriate and reasonable technical and organizational security measures designed to protect any Personal Information we process from accidental, unlawful, or unauthorized disclosure, use, loss, destruction, alteration, or access. Despite our safeguards, no electronic transmission over the Internet or information storage technology is guaranteed to be 100% secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security measures, so transmission of Personal Information is at your own risk, and you should only access our Communication Channels within a secure environment. 

  1. DATA RETENTION

We will retain your Personal Information for the period we believe reasonable to fulfill the purposes for which we hold it, as outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

The criteria used to determine our retention periods include the length of time we have an ongoing relationship with you and provide products or services to you; whether there is a legal obligation to which we are subject (for example, certain laws require maintaining records of your transactions for a certain period of time before we can delete them); and whether retention is advisable considering our legal position. We may retain a copy of your Personal Information to the extent required to comply with requirements of applicable law, professional record-keeping obligations, internal compliance procedures or document retention policies, or any competent judicial, governmental, regulatory or supervisory body, including in the event of and following a business transaction described above.

The Communication Channels are intended for use in the United States of America only and are not at this time directed to any individuals that may reside outside of the United States of America. RangeWater Real Estate, LLC is organized under the laws of the State of Georgia where it is based. We do not market directly to or solicit consumers outside of United States of America where international data protection laws may apply. 

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the Personal Information that we maintain about you and how we process it, correct inaccuracies, get a copy of, or delete your Personal Information. You may also have the right to withdraw your consent to our processing of your Personal Information, or to appeal our decision in response to your requests related to your Personal Information. For the purposes of this section alone, “Personal Information” is used as it is defined by the CCPA, which is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. Personal Information does not include deidentified or aggregate information, publicly available information that is lawfully made available from federal, state, or local government records, and information covered by certain sector-specific privacy laws. 

California State Law Privacy Rights

Your individual privacy rights in California may include the following:

  • The Right to Know: You have the right to request, twice in a 12-month period, that we disclose to you the categories and specific pieces of Personal Information we have collected about you used, disclosed and sold about you during the past 12 months. 
  • The Right to Delete: You have the right to request that we delete certain Personal Information we have collected from you, subject to exceptions including that we need the Personal Information to:
    • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities and to help to ensure security and integrity to the extent the use of your Personal Information is reasonably necessary and proportionate for those purposes.
    • Debug products to identify and repair errors that impair existing intended functionality.
    • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
    • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
    • Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s ability to complete such research, if you previously provided informed consent.
    • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which you provided the information.
    • Comply with a legal obligation.
    • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
  • The Right to Correct: You have the right to request that we correct inaccurate Personal Information that we maintain about you. 
  • The Right to Opt Out of Selling/Sharing for Advertising: You have the right to opt out of the sharing of your Personal Information for cross-context behavioral advertising. 
  • The Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to direct us to only use your Sensitive Personal Information (for example, your social security number, financial account information, your precise geolocation data, or your genetic data) for limited purposes, such as providing the services or products you requested.
  • The Right to Appeal. If we decline to take action regarding your request, we will notify you and provide our reasons and instructions for how you can appeal the decision. If the appeal is denied, we will provide you with instructions for contacting the Attorney General about the decision.
  • The Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights. You acknowledge that your exercise of certain rights may render you unable to use or access certain features, services, or properties.

Types of Personal Information Under CCPA

During the preceding twelve (12) months, we have collected, processed, and/or shared the following categories of Personal Information for a business or commercial purpose, to comply with law, in connection with a transaction, or for other business reasons:

  • Identifiers: such as name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver’s license number, passport number, or other similar identifiers. 
  • Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)): such as name, signature, Social Security number, physical characteristics or description, address, or telephone number. Some Personal Information included in this category may overlap with other categories.
  • Protected classification characteristics under California or federal law: such as age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth, and related medical conditions), sexual orientation, veteran, or military status.
  • Commercial information: such as records of products or services purchased, obtained, or considered.
  • Internet or other similar network activity: such as information about a consumer’s interaction with a website, application, or advertisement.
  • Geolocation Information: such as information such as your physical location or your IP address.
  • Sensory Information: such as pictures, videos, and sounds.
  • Education, Professional or Employment-related information: such as job history, job title, job duties and accomplishments, and other information available on a CV, or other publicly facing information.
  • Inferences: information reflecting your preferences and interests.
  • Sensitive Personal Information: such as social security number, driver’s licenses, and account log-ins and passwords.

Targeted Advertising Disclosure

We use and have used within the last twelve (12) months cookies and other online tracking technologies that may be considered a “sale” or “sharing” when processed for “behavior-based” or “targeted” advertising purposes as defined under applicable state law. Categories of Personal Information disclosed that may be considered “sale” or “sharing” include Identifiers, Commercial information, Internet or network activity, Geolocation information, and Inferences, which may be used by certain of our advertising and marketing partners, data analytics providers, and media networks. You may opt out of behavior-based or targeted advertising by submitting a written request according to the instructions in the How to Contact Us section of this Privacy Policy. California “Shine The Light” Law

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits users who are California residents to request and obtain from us, once a year and free of charge, information about the categories of Personal Information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of third parties with which we shared Personal Information in the immediately preceding calendar year.

  1. Additional Information for Residents of Other States

State Law Privacy Rights

Subject to certain limitations, you may have the following rights in relation to your Personal Information:

  • The Right to Access. You may have the right to confirm what Personal Information is being processed and access such data.
  • The Right to Correct. You may have the right to correct inaccuracies in your Personal Information that we hold.
  • The Right to Delete. You may have the right to delete Personal Information that you have provided to us or that we have obtained about you.
  • The Right to Opt Out. You may have the right to opt out of the processing of your Personal Information for targeted advertising, the sale of Personal Information, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
